qathet Regional District repeals zoning bylaw

Krompocker Road initiative had first and second reading but has been removed from agenda

qathet Regional District Electoral Area B director Mark Gisborne put forward a motion to remove a zoning bylaw for Krompocker Road from the books. The bylaw had received first two readings, but the planning committee voted not to send it to the regional board for third reading and adoption.

qathet Regional District (qRD) board of directors received a public hearing report for the Krompocker Road zoning bylaw that was not advanced to the board for approval.

At an April 24 meeting, directors did not endorse a proposed minor amendment to the zoning bylaw to revise the definition for agriculture, and that the amendment be incorporated into the bylaw before third reading and final adoption.

The board passed the motion to receive without any discussion. On discussion regarding the proposed minor amendment, Electoral Area B director Mark Gisborne said the bylaw was defeated by the planning committee.

“It’s highly unlikely we are going to adopt the zoning bylaw, so I figured why not just vote this item down,” said Gisborne. “At this point, third reading and final adoption is incredibly unlikely. If it’s okay with everyone around the table, I would put forward a motion that the board repeal first and second reading of the bylaw.

“For the zoning bylaw, we gave first and second reading, but we have shot down third reading and adoption. To put the whole item to bed, let’s vote down this item and then I’ll put forward a motion that we repeal first and second reading.”

Manager of planning services Laura Roddan said it’s at the preference of the regional board whether it wants to repeal first and second reading. She said the Krompocker Road bylaw currently sits at second reading.

Electoral Area C director and board chair Clay Brander asked if there would be any harm in endorsing the second part of the motion in the off chance that somebody wants to bring it back to the board. Roddan said there is no harm in it sitting there.

Gisborne said if the board didn’t repeal first and second reading, the bylaw would still be sitting and it could be a long time before it expires and is off the books.

“That way, when members of the public are confused, thinking it may come back, if we repeal it, we can tell the public it’s done,” said Gisborne. “It’s not going to re-emerge like a zombie bylaw.”

The motion to amend the bylaw did not pass. Gisborne then brought forward a motion to repeal first and second reading.

Electoral Area A director Jason Lennox, in whose electoral district Krompocker Road is situated, said he had already been asked about what is transpiring with relation to the bylaw.

“To clear it up, I am supportive of this motion,” said Lennox.

The motion to repeal carried.
