City of Powell River council has given direction for city staff to take a proactive approach in dealing with the Agricultural Land Commission (ALC) over a recent ruling that refused authorization of the Hemlock Street right of way where it loops into a small piece of the Agricultural Land Reserve.

The ALC has given the city three options. The first is a request for reconsideration because the commission does not have all of the facts. The second is the chair of the ALC has 60 days to review the decision and determine if it should be reconsidered. The third option is for the ALC to move ahead with an order to remove the road and/or fine the city a penalty.

At its April 3 committee of the whole meeting, council decided not to wait. Instead, city staff was told to make a submission to the ALC demonstrating other ideas and potential solutions that could be considered in the final decision.  

The city received a letter from the ALC in April 2017 stating the road was not in compliance with the ALC Act.
